TAX TRANSPARENCY AND PROPERTY Many enquiries have been triggered by UK resident, non-UK resident, or non-domiciled individuals seeking reassurance about the enhanced information sharing arrangements between governments. The Common Reporting Standard (CRS) has created unprecedented global transparency. In the meantime, there has been a succession of complex changes to the taxation of UK residential property. For those relocating around the world, it has never been more important to obtain accurate and bespoke tax advice. If you are a non-UK resident and already own or are looking to buy property in the UK, we’ll explain the UK tax implications, both for its purchase and if you decide to sell it later. Stamp taxes, capital gains tax, annual tax on enveloped dwellings and even income tax and inheritance tax can all have an impact. You may also need to comply with additional reporting requirements. We will make all of this clear, and help you plan for it.
RESIDENT OR NON-DOMICILE? It can be difficult to understand whether you are a UK resident or non-domicile for tax purposes. It’s important to know the answer, as this will have an impact on the tax you pay and how you pay it. Our page on Tax Residence and Domicile explains the UK Statutory Residence Test and gives more details on ascertaining your tax residency status. We regularly advise domiciled and non-UK domiciled on the most tax efficient vehicles for their personal and business assets. These can involve offshore trusts and companies, although HMRC’s crackdown on tax avoidance means this route must be very carefully navigated. If you’re yet to arrive in the UK, it can be advantageous to restructure your financial affairs first.
